食品安全法宣传告知单

为了加强餐饮服务监督管理,保障餐饮服务环节食品安全,保障中站区广大消费者身体健康和生命安全。现将食品安全法有关规定告知大家。

《中华人民共和国食品安全法》已于200961日正式实施。根据该法规定,餐饮服务单位需取得《餐饮服务许可证》后,方可从事餐饮服务经营活动,且须在经营场所亮证经营。餐饮服务单位经营的范围应符合许可证核定的项目。

第一,从事餐饮服务的单位和个人,应当取得《餐饮服务许可证》,并依法承担餐饮服务的食品安全责任。领《餐饮服务许可证》所需条件

(一)具有全封闭的操作间,应距离粪坑、污水池、垃圾场25m以上,并应设置在粉尘、有害气体和其他扩散性污染源外;

(二)具有与制作供应的食品品种、数量相适应的经营设备或者设施,有相应的消毒、更衣、洗手、采光、照明、通风、冷冻冷藏、生熟标志、防尘、防蝇、防鼠、防虫、洗涤以及处理废水、存放垃圾和废弃物的设备或者设施,有食品安全专业技术人员管理人员和保证食品安全的规章制度

(三)具有合理的布局和加工流程,防止待加工食品与直接入口食品、原料与成品交叉污染,避免食品接触有毒物、不洁物;

(四)食品生产经营人员应当保持个人卫生,生产经营食品时,应当将手洗净,穿戴清洁的工作衣、帽;销售无包装的直接入口食品时,应当使用无毒、清洁售货工具

第二,餐饮服务单位如在没有办理《餐饮服务许可证》的情况下,从事餐饮服务工作的单位,将按照《中华人民共和国食品安全法》第八十四条规定,未经许可从事食品生产经营活动,由食品药品监督管理部门按照职责,将对其没收违法所得、违法生产经营工具、设备、原料等物品;违法生产经营的食品、食品添加剂货值金额不足一万元的,并处二千元以上五万元以下罚款;货值金额一万元以上的,并处货值金额五倍以上十倍以下罚款。 第三,为了规范餐饮服务食品采购索证索票行为,国家食品药品监督管理局制定了《餐饮服务食品采购索证索票管理规定》,规定要求:

(一)建立食品、食品原料和食品相关产品的采购查验和索证索票制度,确保所购原料符合食品安全标准,并便于溯源。

(二)采购食品及原料应到证照齐全有效、具备相应资质、有相对固定经营场所的食品生产经营单位。采购需冷藏或冷冻的食品时,应冷链运输。与固定供应商采购食品时,签订采购供货合同。

(三)直接从食品生产单位、批发市场等采购食品及原料,应当查验、索取并留存供货者的相关许可证和产品合格证明等文件;从固定供货商或者供货基地采购的,应当查验、索取并留存供货商或者供货基地的资质证明、每笔供货清单等;从超市、农贸市场、个体经营商户等采购的,应当索取并留存采购清单;使用集中消毒式餐饮具的,应索取供货厂家营业执照及消毒合格证明。证明资料为复印件,宜有供货者盖章或签字确认。

(四)建立食品及原料采购记录台账,如实记录产品名称、规格、数量、生产批号、保质期、供货者名称及联系方式、进货日期的内容,保留载有上述信息的进货票据或填写购物凭证。

(五)实行统一配送经营方式的,可以由企业总部统一查验供货者的许可证和产品合格的证明文件等,建立食品进货查验记录。企业各门店应当建立总部统一配送单据台账。门店自行采购的产品,应当遵照以上规定执行查验索证索票制度。

(六)按照产品品种、进货时间先后次序整理采购记录及相关资料,妥善保存备查。记录、票据的保存期限不得少于2年。

(七)采购的食品必须符合国家有关安全标准和规定,禁止采购《食品安全法》28条规定禁止生产经营的食品。预包装食品及食品添加剂标签要求应符合《食品安全法》第42474866条的规定。
